Abstract

An Act to prevent the introduction of harmful organisms into plants and plant products. The Act contains at the outset a definition clause relating to the various terms therein employed, such as "plants", "plant products", "harmful organism", "member countries", etc. Article 3 indicates the national and regional competent authorities; all of them form the Official Austrian Plant Protection Service. The definition of a "protected area" in the European Union is set out in article 4. Part 3 governs the introduction of plants affected by one of the harmful organisms as set out in Annex 2 into member countries. Import from and export to third countries are treated, respectively, in Part 4 and 5. Finally, Part 6 prescribes the penalties in case of violation, and other provisions. The Act consists of 47 articles divided into 7 Parts and 4 Annexes.
