Abstract

This Order, made under sections 2, 3 and 4 of the Plant Health 1967, provides measures for the control of international trade in any plant, plant product, soil or growing medium ("relevant material") for the purpose of preventing the spreading of plant pests and diseases. Part 2 of the Order imposes restrictions and requirements on relevant material imported into Scotland from third countries. Article 5 contains general prohibitions and restrictions on relevant material being landed in Scotland. Part 3 of the Order contains the prohibitions and restrictions that apply to relevant material coming to Scotland from other EC countries (including other UK countries) and to the movement of that material within Scotland. Such material shall be accompanied by a plant passport. Part 4 of the Order imposes a requirement on plant traders to be registered and enables the Scottish Ministers to authorize such traders to issue plant passports. Other provisions of these Regulations contain special arrangements governing trade in relevant material between Scotland and Switzerland, give general enforcement powers to plant health inspectors, imposes additional requirements in respect of potatoes and tomatoes, provide for exemptions to be granted by the Scottish Ministers, require the notification of plant pests and diseases and prescribe offences.
