Part III concerns application for and grant of plant breeder's rights; under the Act plant breeder’s rights shall be granted only in cases of a new variety of plant genera and species or in respect of new varieties of a preserved kind. The Act provides for refusal, appeal, objection, cancellation, surrender, etc. The holder of plant breeder’s rights may grant to any person exclusive or non exclusive licence relating to all or any of the rights provided; in granting any licence, the holder of the plant breeder's rights may impose such conditions, limitations or restrictions as he deems fit.
