They apply to National Government ministries, departments and agencies, private sector entities, among others. Furthermore, they apply to a range of projects including, projects for the implementation of National Government functions; projects for the implementation of functions not assigned to either level of government that are undertaken by the government for the social and economic well-being of Kenyans; projects implemented by the private sector in special economic zones and export processing zones; projects undertaken by regional development authorities, etc. The Regulations define strategic and inter-county projects to be projects that are implemented on public land held by the National Government, or funded by the National Government.
