Abstract

Regulations promulgated by the Republic of Palau Environmental Quality Board (“the Board”). These Regulations establish and maintain a system of control over the importation, distribution, sale and use of pesticides by persons within the Republic of Palau (reg. 2). The Regulations are divided into 9 Paragraphs: General provisions; Administration of EQPB Regulations; Unlawful acts; Certification of applicators; Licensing of restricted use pesticide dealers; Records; Importation; Restricting and banning of pesticides; Revocation of registration of a pesticide used to meet a special local need; Enforcement; Experimental use permits; Penalty for violation; Restricted and banned use pesticides; Miscellaneous. Regulation 3 contains definitions. The Chairman of the Board is authorised under regulation 4 to take such action as may be necessary for the administration or enforcement of these Regulations. Regulations 7 to 16 concern the certification and operation of commercial or private applicators, i.e. persons who use or supervise the use of restricted use pesticides, being pesticides, one or more uses of which have been restricted by the Board under these Regulations or under the Federal Insecticide, Fungicide, and Rodenticide Act. Regulation 19 requires specified records to be kept by Commercial Applicators, whereas regulation 20 prescribes similar requirements for licensed dealers. Every person engaged in sale or distribution of restricted pesticides or any person importing such pesticides other that a commercial applicator, shall obtain a licence of the Board under regulation 17. The Board may ban pesticides under regulation 28. (36 regulations)
