It regulates their import and use, so as to minimize the risks to people and the environment. Part I contains the definitions used in the Act. Part 2 describes the administrative aspects of the Act. There is a Registrar of Pesticides who will maintain a Register of Pesticides (sect. 4). There shall also be a Pesticides Committee who will decide whether a pesticide should be registered (sec .5) and Inspectors to make sure that the provisions of the Act are being observed (sect. 6). Part 3 of the Act deals with the control of pesticides. Only those pesticides which are registered may be used in Tuvalu. Unless a pesticide is registered, it cannot be imported and an import permit is required. Conditions dealing with transport, storage, supply, use and disposal of pesticides, may be attached to the permit (sect. 8). Section 8 also contains the procedure for applying for registration of a pesticide. The Committee may grant the application, require more information or refuse it. If the effects of a pesticide are likely to create a serious risk of harm, registration must be refused. Any registered pesticide must be kept in an approved container with an approved label. Any change to a registration shall be published (sect. 9). In Part 4, importation into Tuvalu of pesticides is controlled by a system of import permits (sect. 10). Provisions of the Customs Act, relating to importation of prohibited or restricted imports shall be applicable (sect. 11).
