They prescribe that any person who produces, places on the market or uses a substance in contravention of Article 3 of Regulation (EC) No. 850/2004 shall be guilty of an offence and that all duties placed on the member State in Regulation (EC) No. 850/2004 must be executed by the Secretary of State or the relevant enforcement authority. The chemical substances, specified in the Annex to the Community Regulation are transported across international boundaries far from their sources and they persist in the environment, bioaccumulate through the food web, and pose a risk to human health and the environment.
