Abstract This Order, consisting of 115 sections divided into 20 Parts, and made under article 83(3) of the Constitution, establishes the requirements to be met in order to register inventions or intellectual properties used for any industrial application or in any kind of industry, including agriculture. An invention of a treatment for human or animal body by surgery or therapy or of diagnosis practised on the human or animal body shall not be taken to be capable of industrial application. Part 2 establishes a Registrar of Patents who shall have the chief control of the Registry of Patents under one or more Deputy Registrars of Patents who have the powers and functions of the Registrar. There shall be one or more Assistant Registrars of Patents. The Registrar may: summon witnesses; receive evidence on oath, whether orally or otherwise; require the production of documents or articles; and award costs against a party to proceedings before him. A patentable invention is one that satisfies the following conditions: the invention is new; involves an inventive step; and is capable of industrial application. Part 3 specifies Patentable inventions; Parts 4 and 5 deal with Right to apply for and obtain patent; Parts 6 and 7 provide for the procedures to grant a patents; Part 8 specifies the requirements for Registration of patents.
