Abstract

This Regulation establishes the procedure for recognizing waste generated as a result of the destruction of goods as unsuitable for their further commercial use. In order to recognize the waste generated as a result of the destruction of goods as unsuitable for their further commercial use, a Commission is set up by decision of the state revenue body. The Commission includes representatives of the state revenue body, its territorial divisions, industry and other government bodies, organizations, as well as the National Chamber of Entrepreneurs of the Republic of Kazakhstan “Atameken” and their branches. Members of the Commission must submit to the state revenue body expert opinions on the possibility and (or) impossibility of further commercial use of waste within 5 (five) working days from the date of the Commission meeting. The decisions of the Commission are made by a simple majority of votes from the total number of members of the Commission present. In case of equality of votes, the chairman's vote is decisive. The decision of the Commission is made taking into account expert opinions (conclusions) and is documented in a protocol.
