Abstract

This Order establishes the modalities of calculation of damages caused to waterbodies by the infringement of water legislation and, in particular, for the calculation of damages that have caused water pollution, clogging or exhaustion of water. It shall be applicable to the following main damages: (a) water pollution by hazardous substances (pollutants) contained in effluent waste water; (b) water pollution caused by accidental oil spill; (c) discharge of effluent waste water from ships; (d) clogging of water area by industrial and consumer waste, including clogging by abandoned and sunken vessels; and (e) clogging of water area by prohibited timber floating and timber rafting without ship traction. Calculation of damages shall be based upon compensation principle with indemnification of damages to the full extent and payment for the mitigation of the consequences of the offence. The Order contains calculation formula.
