Abstract

This Instruction establishes the procedure and requirements for the provision of test samples for examination of applications for plant varieties. It shall be applicable to natural persons and legal entities supplying a test sample for the purpose of examination of an application for a plant variety to a competent state authority in the field of protection of rights to plant varieties for the purpose of conducting scientific and technical examination of the application for a plant variety. Documentary confirmation is a notice of acceptance of the application for consideration and import of experimental samples of plant varieties for the purpose of examination of the application (Annex 1), which is issued by the Competent Authority and sent to the applicant within ten calendar days from the date of registration of the application and accompanying documents for the plant variety and is attached to the documents for customs clearance. The notification is not a permit document, it is informative in nature and is issued by the Expert Institution, if it is authorized to do so by the Competent Authority. Depending on the botanical taxon, the sample may be represented by seeds or planting material (seedlings, cuttings, tubers, bulbs, etc.). Research samples of plant varieties imported into Ukraine for purposes of examination of the application must meet the following requirements: (a) the sample must belong to a certain category of seeds and be accompanied by a label of the experimental sample (Annex 2); (b) the sample must be packed in a container such as to avoid any possible damage; (c) the sample, represented by planting material (seedlings, cuttings, cuttings, etc.), must have a well-developed root system, not be affected by diseases and damaged by pests; and (d) a sample that was not subjected to chemical treatment is supplied for examination, except for sugar and fodder beets.
