Abstract

Fishing Regulation in the Volga-Caspian fishery basin regulates activities of Russian legal entities, individual entrepreneurs and natural persons, fishing in the Caspian Sea and inland waters of the Russian Federation within fishing areas specified in paragraph 2 of the Regulation, as well as foreign legal entities and natural persons, fishing in accordance with the legislation of the Russian Federation and international treaties of the Russian Federation. Fishing Regulation regulates harvesting (catch) of aquatic biological resources for the purposes of industrial (commercial) fishing, coastal fishing, fishing for research and control purposes, fishing for educational and cultural purposes, fishing for aquaculture (fish farming), recreational and sport fishing. Fishing Regulation establishes: (a) types of authorized fishing; (b) fishing rates, including rates of yield of products of processing of aquatic biological resources, including caviar, as well as the parameters and terms of the authorized fishing; (b) restrictions on fishing and other activities related to the use of aquatic biological resources, including: fishing ban in certain areas and for certain species of aquatic biological resources; (c) prohibition of fishing in certain areas and in relation to certain types of aquatic biological resources; (d) minimum size and weight of caught (harvested) aquatic bioresources; (e) types and number of authorized fishing hunting gear and methods; (f) size of the mesh of fishing gear; (g) distribution of fishing areas between groups of vessels, differing by fishing gear, types and sizes; (g) periods of harvesting (catch) of aquatic biological resources for groups of vessels, differing by fishing gear, types (power) and dimensions; (h) authorized by-catch of certain species in the course of harvesting (catch) of other types of aquatic biological resources; and (i) periods of fishing in waterbodies of fishery significance. In order to preserve endangered species listed in the Red Book of the Russian Federation and/or the Red Book of the subject (region) of the Russian Federation of rare and endangered species of aquatic biological resources harvesting (catch) of such species of aquatic biological resources is prohibited. Legal entities and individual entrepreneurs must ensure separate accounting of catch of aquatic bioresources and acceptance of catches of aquatic biological resources by types of aquatic biological resources, indication of weight (size) or piece (for aquatic mammals) ratio species in the catch of aquatic biological resources, fishing gear (catch) and fishing areas (area, subarea, fishing zone, fishing subarea, sector) in the fishing log and other reporting documents. When fishing, it is prohibited: (a) for legal entities and individual entrepreneurs to harvest (catch) aquatic biological resources without fishing authorization (with the exception of catch of permitted by-catch; (b) without distributed quota for harvesting (catch) of aquatic biological resources, unless otherwise provided by the legislation on fishing and conservation of aquatic bioresources; (c) in the absence of a person responsible for harvesting (catch) of aquatic biological resources (when fishing without using fishing vessels); (d) in excess of the allocated quotas by fishing areas and aquatic biological resources species, as well as without amount of authorized bycatch. Types of aquatic biological resources prohibited for harvesting (catch): beluga, Russian sturgeon, Persian sturgeon, stellate sturgeon, sterlet, Volga zander. This Fishing Regulation establishes prohibited fishing areas, prohibited fishing gear and fishing methods, prohibited fishing species and prohibited fishing periods.
