Abstract

The State Inspection for the Protection of Rights to Plant Varieties is an autonomous branch of the State Service for the Protection of Rights to Plant Varieties entitled to carry out the state control and supervision over the observance of the legislation in the sphere of protection of the rights to plant varieties. The main tasks of the State Inspection are: 1) to carry out the state control and supervision over the observance of the requirements of the legislation on production, utilization, conservation, trade and propagation of planting material; 2) to take part in the state scientific and technical expertise of plant varieties as objects of intellectual property; 3) to ensure the state control and supervision over conservation of plant varieties; 4) to register licensing contracts. The State Inspection shall carry out the following functions: 1) protection of intellectual rights regarding plant varieties; 2) issuing once-only permits for import of planting material (seeds) non-registered in Ukraine for the purpose of scientific research; 3) usage of the names of plant varieties’ names in the official publications.
