Abstract

Fishing rules for the Far Eastern fishery basin regulate the activities of the Russian legal entities, individual entrepreneurs and citizens, including persons belonging to the indigenous peoples of the North, Siberia and the Far East of the Russian Federation, and their communities, engaged in fishing in the internal waters of the Russian Federation, including in the internal sea waters of the Russian Federation, territorial sea of the Russian Federation, continental shelf of the Russian Federation, Exclusive Economic Zone of the Russian Federations within the Far Eastern Fisheries Basin, with the exception of waterbodies or their parts located in protected areas of federal significance, within which fishing is prohibited by the legislation of the Russian Federation on protected natural areas of federal significance, as well as foreign legal entities and citizens engaged in fishing in accordance with the legislation of the Russian Federation and international treaties of the Russian Federation. The Far Eastern fishery basin includes: the Chukchi Sea with the basins of the rivers flowing into it, the Bering Sea with the basins of the rivers flowing into it, the waters of the Pacific Ocean, adjacent to Eastern Kamchatka and the Kuril Islands with basins flowing into it rivers, the Sea of Okhotsk with the basins of the rivers flowing into it, the Sea of Japan with basins of rivers flowing into it, as well as waterbodies located on the land territory of the Russian Federation within the borders of the Chukotka Autonomous Area, Primorie, Khabarovsk and Kamchatka Territories, Jewish Autonomous Region, Sakhalin, Magadan and Amur areas bounded by the basins of the above rivers, with the exception of ponds and flooded quarries owned by entities of the Russian Federation, as well as municipal and private property. Fishing rules regulate harvest (catch) of aquatic biological resources (freshwater fishes, marine fishes, diadromous fishes, crustaceans and molluscs) in the process of performance of commercial fishing, coastal fishing, fishing for research and control purposes, fisheries for educational and cultural, fisheries for aquaculture (fishfarming), recreational fishing, fisheries to ensure traditional way of life and the performance of traditional economic activities of the indigenous peoples of the North, Siberia and the Far East of the Russian Federation. Fishing rules establish: (a) types of authorized fishing; (b) standards and rates, including the norms for the output of fish products derived from processing of aquatic biological resources, caviar, as well as the parameters and terms of authorized fishing; (c) restrictions on fishing and other activities related to the management of aquatic biological resources, including: prohibition of fishing in certain areas and in relation to certain types of aquatic biological resources; closure of fisheries in certain areas and in relation to certain types of aquatic biological resources; minimum size and weight of harvested (caught) aquatic biological resources; types and number of authorized fishing gear and methods of extraction (catch) of aquatic biological resources; mesh size of tools for extraction (catch) of aquatic biological resources, size and the design of fishing gear; distribution of fishing areas (area, subarea, fishing zone, fishing subzone) between groups of vessels, differing in fishing gear; periods of harvesting (catch) of aquatic biological resources for groups of vessels, differing in types (power) and dimensions; the number and types (capacity) of vessels that can carry out industrial fishing and coastal fishing at the same time in one fishing area; the minimum volume of production (catch) of aquatic biological resources per vessel; time for vessels to go to sea for the implementation of industrial fisheries and coastal fisheries; authorized by-catch of some species in the course of harvesting (catch) of other aquatic biological resources; periods of fishing in waterbodies; (d) requirements for the conservation of aquatic biological resources, including obligations of users, list of documents required from users, requirements to users; and (e) daily rate of harvesting (catch) of aquatic biological resources (quantity, weight) allowed to a citizen for harvesting (catch) in the process of performance of recreational fishing.
