Abstract

The present Instruction establishes the modalities of carrying out competent expertise of plant species and regulates the relations originating from and in the process of application and protection of property rights to the plant varieties. The state registration of plant variety and plant species that are not subject to the state testing shall by carried out under the responsibility of the applicant in conformity with the description of and indices proving of the suitability for spreading thereof on the territory of Ukraine. Plant variety and plant species must comply with the requirements established by the national legislation. Patent, authorship certificate and the state registration certificate shall be issued upon the responsibility of the applicant and shall have declarative value. The State Service for the Protection of Rights to Plant Varieties shall make the decision on the state registration of the plant variety and/or the rights of ownership thereto by means of recording the data referring thereto in the State Register of the Rights of the Owners of Plant Varieties and in the State Register of the Plant Varieties authorized for spreading on the national territory.
