Abstract

Fishing Regulation in Lake Baikal fishery basin regulates the activities of Russian legal entities, individual entrepreneurs and citizens, including persons belonging to the indigenous peoples of the North, Siberia and the Far East of the Russian Federation and their communities, performing fishing in the internal waters of the Russian Federation, with the exception of waterbodies or their parts located in protected areas of federal significance, within which fishing is prohibited in accordance with the legislation of the Russian Federation on protected areas of federal significance, as well as foreign citizens engaged in recreational fishing in accordance with the legislation of the Russian Federation. Fishing Regulation establishes the procedure for the extraction (catch) of aquatic biological resources for the purpose of commercial fishing, fishing for research and control purposes, fishing for educational and cultural purposes, fishing for aquaculture (fishfarming), recreational fishing, as well as fishing for ensuring traditional way of life and carrying out traditional economic activities of the indigenous peoples of the North, Siberia and the Far East of the Russian Federation. Fishing Regulation establishes authorized types of fishing, rates of the output of fish products, including caviar, parameters and terms of authorized fishing, and restrictions of fishing, use of fishing gear and fishing methods. It also establishes fishing gear and fishing methods, fishing areas and fishing periods, species, sex and size composition of catches of aquatic biological resources for fishing for research and control purposes, for educational and cultural, as well as for the purposes of aquaculture (fishfarming) in accordance with annual plans for conducting resource studies of aquatic biological resources, catalogue or plans for cultural and educational activities, as well as programs for the implementation of work in the field of aquaculture (fishfarming), approved in accordance with the procedure established by the legislation of the Russian Federation. Recreational fishing in fishing areas allotted on the basis of agreements for the use of a fishing area or agreements on the provision of a fishing area for organizing the specified type of fishing is carried out by citizens if they have a voucher (a document confirming the conclusion of an agreement for the provision of paid services in the field of recreational fishing) issued by a legal person or individual entrepreneur. The voucher must indicate the amount of aquatic biological resources agreed for extraction (catch), the area of extraction (catch) within the fishing (fishing) area, gear and methods of extraction (catch), and the period of its validity.
