Abstract

This Order establishes the procedure for state registration of vessels, rights thereto and therewith at seaports of the Russian Federation, as well as the procedure for the centralized registration of registered vessels (centralized accounting) in accordance with the terms of state registration, established by the Mercantile Marine Code. It regulates the relationship between the owner of the vessel, the shipowner, legal and physical persons exercising property rights to a vessel on any legal ground, including public authorities, local government bodies, bailiff, lessor, creditor, trustee, on one hand, and captain of seaport, which carries out the state registration of vessels, rights thereto and transactions therewith, on the other hand, performed in the course of state registration. The functions of captain of seaport are performed by the captain of seaport r on its behalf by the officials of the captain of seaport's office. The following vessels shall be subject to state registration: (a) vessels owned by the Russian Federation, constituent entities of the Russian Federation, municipal entities, citizens of the Russian Federation, legal entities, registered in accordance with the legislation of the Russian Federation; (b) vessels registered in the vessels register of foreign courts and granted for use and possession to a Russian charterer under a bareboat charter contract (bareboat charter), in the cases provided for in article 15, paragraph 2 of the RF Mercantile Marine Code; (c) newly built ships; (d) property right and other proprietary rights to the vessel, restrictions (encumbrances) on these rights (mortgages, fiduciary management and others), their occurrence, transition and termination.
