Abstract

This Order establishes that with a view of conservation and reproduction of fish stocks and other aquatic animals can be imposed restrictions and prohibitions on the use of wild fauna species, in particular fish species and aquatic animals, with the consideration of geographic and climatic areas of distribution thereof and their natural habitats. The aforesaid restrictions and prohibitions shall not be applicable to scientific research (by governmental order), control and ameliorative fisheries and fisheries for reproduction purposes. It applies a ban on bycatch of other species of fish and fish of non-commercial measure of quantity exceeding 8% of the catch in meshed fishing gear and 5% in impounding fishing gear. A ban shall be imposed on the following types of fisheries: (a) with the use stabbing fishing gear (spear, lance, trap), self-activating fishing gear (automatic traps, trotline, set line), explosives and toxic substances, and also firearms; (b) by methods and means, fishing gear, the use of which is not envisaged by fisheries regulations and not included in the list of authorized fishing gear; (c) by fishing gear with smaller mesh that authorized by fisheries regulations; (d) in wintering holes in winter period, in spawning grounds during spawning period and in other fishing areas, locations and period established by these restrictions and prohibitions; (e) along migratory routes and in places of concentration and reproduction of fish stocks; (f) by harpooning, pursuit, clanking and driving the fish into the nets; and (f) catch of fish species and other aquatic animals of less than commercial size established by fisheries regulations.
