Abstract

This Order establishes regulations which complement pesticide rules on the approval, manufacture, international trade, use, possession and inspection of pesticides. The document also provides rules for national authorization of biocide products referred to in the Chemical Act’s article 35, section 1 and the improved protection of data thereof. This Order does NOT apply to the transport and export of pesticides. The Environmental Protection Agency (EPA) shall regulate tasks conferred on national competent authorities, including the evaluating competent authorities, and shall approve biocide products authorization for use. Submitted applications for the approval of pesticides must indicate whether the agent can be described as hazardous. Until 30 May 2015 the classification of pesticides shall be in adherence to classification regulations, whereby these applications must specify the classification rules used for the control of pesticides. Labelling of biocide products shall implement regulations in adherence to article 69 whilst pesticides shall be labelled in accordance to articles 64-65 of biocide regulations with a validity of a maximum of ten years. Import and trade of biocide products shall be subject to prior authorization by the minister of Environment to ensure compliance with EU regulations. Chemical control of rats must be performed by an authorized person as defined in the Order on the prevention and control rats (art. 27). Permit fees shall be equivalent to DKK 1 500 yearly for pesticides classified as acute toxicity category 1 or 2, or as specific measurements in Category 1 (STOT SE 1). Yearly fee of DKK of 750 shall apply to authorizations of pesticides classified as acutely toxic (category 3).
