Order No. 109 of the Ministry of Natural Resources validating the Regulation on forest management for the exploration of subsoil and management of mineral deposits.

Abstract

This Order sets out modalities and requirements of forest management for the exploration of subsoil and management of mineral deposits. Plots of forests pertaining to state and municipal property shall be allotted for the exploration of subsoil and management of mineral deposits in accordance with articles 43 and 74 of the Forest Code. The exploration of forest stock subsoil may be carried out without allotting plots of land; in such cases the applicant must file an application with the local self-government unit specifying: (a) complete data of the applicant; (b) location and area of the forest stock requested for exploration activity; (c) extract from the State register of legal persons; (d) copy of the registration certificate issued by the state tax inspector; (e) copy of the exploration licence; and (f) map of the forest stock area in which the exploration activity is requested. In the process of exploring subsoil and managing mineral resources, the following activities shall be prohibited: (a) woodcutting and forest clearing with the use of bulldozers; (b) flooding of forest plantations; (c) littering up; (c) those resulting in emissions of chemical or radioactive pollution; and (d) passing with vehicles and other mechanisms through unauthorized routes.
