Abstract

Fishing rules for the Sea of Azov and the Black Sea fishery basin regulate the activities of Russian legal entities, individual entrepreneurs and natural persons engaged in fishing in the Sea of Azov, as well as in the internal waters of the Russian Federation, including in the internal sea of the Russian Federation, the territorial sea of the Russian Federation, the continental shelf of the Russian Federation and in the Exclusive Economic Zone of the Russian Federation in the Black Sea, within the specified areas (with the exception of waterbodies or their parts located on protected areas of federal significance, within which fishing is prohibited in accordance with the legislation of the Russian Federation on protected areas of federal significance), and foreign legal entities and natural persons carrying out fishing in accordance with the legislation of the Russian Federation and international treaties of the Russian Federation in the Sea of Azov, and in the internal sea of the Russian Federation, territorial sea of the Russian Federation, continental shelf of the Russian Federation and in the Exclusive Economic Zone of the Russian Federations in the Black Sea. The Azov-Black Sea fishery basin includes the Black Sea and the Sea of Azov with the basins of the rivers flowing into them and all waterbodies of fishery importance of the Republic of Adygea, the Republic Kalmykia (with the exception of the Caspian Sea with river basins flowing into it), the Karachay-Cherkess Republic, Krasnodar and Stavropol Territories, Volgograd (river basin Don), Voronezh, Lipetsk, Rostov, Saratov (river basin Don) and Tula regions (Don river basin), with the exception of ponds, flooded quarries, owned by the subjects of the Russian Federation, municipal and private property. Fishing rules regulate harvesting (catch) of aquatic biological resources in relation to industrial fishing, coastal fishing, fishing for research and control purposes, fishing for educational and cultural purposes, fishing for the purposes of aquaculture (fishfarming), recreational fishing, with the exception of official sports events involving the extraction (catch) of aquatic biological resources. Fishing rules establish: (a) types of authorized fishing; (b) norms and rates, including norms for the output of processed fish products, including caviar, as well as parameters and terms of authorized fishing; (c) restrictions on fishing and other activities related to management of aquatic biological resources, including: prohibition of fishing in certain areas and in relation to certain types of aquatic biological resources; closure of fisheries in certain areas and with respect to certain types of aquatic biological resources; the minimum size and weight of harvested (caught) aquatic biological resources; types and number of authorized fishing gear and methods of extraction (catch) of aquatic biological resources; mesh size of fishing gear; distribution of fishing areas (area, subarea, fishing zone, fishing subzone) between groups of vessels differing in the tools for the extraction (catch) of aquatic biological resources, types and sizes; periods of harvesting (catch) of aquatic biological resources for groups of vessels, differing in fishing gear, types (power) and dimensions; the number and types (capacity) of ships that can carry out industrial fishing and coastal fishing at the same time in one area of extraction (catch) of aquatic biological resources; the minimum volume of production (catch) of aquatic biological resources per vessel; time for ships to go to sea for the performance of industrial fisheries and coastal fisheries; authorized by-catch of some species during extraction (catch) of other species of aquatic biological resources; and periods of fishing in waterbodies of fishery significance. In order to preserve species listed in the Red Book of the Russian Federation and (or) the regional Red Books of the Russian Federation of rare and endangered species of aquatic biological resources, harvesting (catch) of such types of aquatic biological resources is prohibited. Fishing rules for the Sea of Azov and the Black Sea fishery basin establish prohibited fishing gear and prohibited fishing methods.
