Abstract

This Code regulates public relations in the field of healthcare with a view of realization of constitutional right of citizens of the Republic of to the protection of health. The purpose of the legislation of the Republic of Kazakhstan in the field of healthcare shall be to ensure that citizens exercise their right to healthcare, including accessible and quality medical care to preserve and strengthen the health of the population of the Republic of Kazakhstan. The objective of the legislation of the Republic of Kazakhstan in the field of healthcare shall be to create legal conditions aimed at improving the health of the citizens of the Republic of Kazakhstan. Competent public authority in the field of healthcare shall organize the formation of a healthy lifestyle and healthy nutrition. Competent public authority in the field of sanitary and epidemiological well-being of the population shall performs the following functions: (a) implementation of state policy in the field of sanitary and epidemiological well-being of the population; (b) determines the procedure for maintaining a register of potentially hazardous chemical, biological substances prohibited for use in the Republic of Kazakhstan; (c) determines the class of hazard of waste according to the degree of their impact on humans and the environment (according to the degree of toxicity); (d) issues sanitary and epidemiological conclusions on the compliance of the object of state sanitary and epidemiological control and supervision, project normative documentation on maximum permissible emissions and maximum permissible discharges of harmful substances into the environment; (e) determines the procedure for assigning registration numbers to the food processing facilities subject to state control and supervision in the field of sanitary and epidemiological well-being of the population, and the maintenance of the aforesaid register; (f) performs radiation monitoring; (g) performs state control and supervision of products subject to state sanitary and epidemiological control and supervision, including foodstuffs; and (h) develops and approves a list of certain types of foodstuffs subject to state control and supervision in the field of sanitary and epidemiological well-being of the population, production of which requires the use of non-iodinated salt. Local government shall perform the following functions: (a) organize the provision of preschool organizations, educational organizations, healthcare and social welfare organizations with iodized salt and other foodstuffs enriched with iodine compounds; and (b) organize hygienic education, promotion and formation of a healthy lifestyle and healthy nutrition. Sanitary-epidemiological conclusion is issued by the state body in the field of sanitary and epidemiological well-being of the population on the basis of results of preventive control and (or) sanitary and epidemiological expertise on materials related to chemical, biological, toxicological, radiological impact on soil, water bodies and atmospheric air. Public officials exercising control and supervision in the field of sanitary and epidemiological well-being of the population shall have the right to: (a) prohibit import, use and trade of falsified, expired products and in the absence of state registration of products; (b) prohibit use of prohibited food additives, ingredients and raw materials; and (c) approval of shelf life and storage conditions of foodstuffs. Citizens of the Republic of Kazakhstan shall have the right to dietary feeding in case of a patient undergoing treatment in an inpatient care. Sanitary rules establish sanitary and epidemiological requirements for facilities subject to state control and supervision in the field of sanitary and epidemiological welfare of the population, and contain requirements for: (a) water supply and sewerage; (b) conditions of processing, packaging, transportation, storage, trade and disposal of foodstuffs. This Code contains 7 Sections divided into 275 Articles. Section 1 lays down general provisions. Section 2 regards protection of public health. Section 3 regards organization of medical assistance. Section 4 regards educational and scientific research activities in the field of healthcare. Section 5 deals with pharmaceutical activities and circulation of medicinal products and medical devices. Section 6 regards human resources policy in the field of healthcare. Section 7 lays down final provisions.
