Abstract

The present Act has been adopted in order to implement the International Convention on Civil Liability for Oil Pollution Damage and the International Convention on the Establishment of an International Fund for Compensation for Oil Pollution Damage. According to section 4, the provisions of articles I to XI of the Liability Convention (which are reproduced in the First Schedule hereby attached) shall form part and be enforceable as part of the Law of Malta. Action for compensation under the Convention shal be broght in Malta before the Civil Court. Further, section 5 establishes that the provisions laid down in articles 1 to 15 of the Fund Convention (which are reproduced in the Second Schedule attached to this Act) shall form part and be enforceable as part of the Law of Malta.
