Abstract

This Act carries into effect in Nauru the Comprehensive Nuclear-Test-Ban Treaty, adopted by resolution of the United nations. It prohibits: (a) carry out any nuclear weapon test explosion or any other nuclear explosion; or (b) cause, encourage, or in any way participate in, the carrying out of any nuclear weapon test explosion or any other nuclear explosion. This applies to: (a) acts done in Niue by any person; and (b) acts done outside Niue- (i) by a resident of Niue; or (ii) by any person on board a ship or aircraft registered in Niue. If an offence against this rule is alleged to have occurred somewhere outside Niue, the person alleged to have committed the offence may be arrested, or a warrant for the person's arrest may be issued and executed. The Act also provides with respect to enforcement, facilitation of international inspectors under disarmament treaties and other matters regarding inspections, legal proceedings, and regulation-making powers of the Cabinet.
