The present Act enters into force on 1 February 1988.
Abstract

This Act has 42 sections followed by a Schedule, which contains a list of noxious weeds. Section 2 states that the Lieutenant Governor in Council may, for any part of the province, declare any plant not included in the Schedule to be a noxious weed. It shall be the duty of every person responsible under this Act to destroy all noxious weeds and prevent the growth, ripening and scattering of weeds or weed seeds, (sect. 3). There is a duty upon every harvester to clean their threshing machines to prevent any possible spread of seeds of noxious weeds. (Sec 4(1)). Section 10 gives the council of the municipality the power to declare land weed infested, and either by agreement or otherwise take such steps necessary to deal with the problem. Sections 8 and11-14 deal with inspectors and section 17 highlights their duties. The weeds inspector may enter upon land for the purpose of ascertaining if noxious weeds are growing (sect. 17(1) and sec 22), and may serve notices on persons responsible for the land to clear such noxious weeds (sect. 17(2)). A penalty is prescribed for non-compliance with such notice (sect. 19). The weeds inspector may have the land cleared at the expense of the person responsible for the land (sect. 38(1)). Section 31(1) establishes the Weed Control Board to control, supervise, and manage a program of control and destruction of noxious weeds within the weed control district. Section 39(1) provides for the appointment of Weed Control Advisory Board to advise on all matters relating to the control and destruction of noxious weeds and on the ways and means of achieving the objectives of the Act. Finally all expenditures are to come from the Consolidated Fund by virtue of section 41.
