Abstract

This Notice was issued to correctly implement the Civil Procedure Law of the People's Republic of China, the Environmental Protection Law of the People's Republic of China, and the Interpretation of the Supreme People's Court of Several Issues on the Application of Law in the Trial of Environmental Civil Public Interest Lawsuits. The people's court which accepts and tries an environmental civil public interest lawsuit filed by a social organization may, as required for the case, consult or verify the basic information of the social organization from the registration administrative authority in charge of such a social organization, including but not limited to the title, residence, formation time, tenets, business scope, legal representative or person in charge, existence, annual inspection, business operation and the records on the violations of law obtained by the registration administrative authority, and the relevant registration administrative authority shall send the relevant information to the people's court in a timely manner. The people's court may decide that the defendant shall organize the restoration of the ecological environment by himself, or entrust the third party to restore the ecological environment.
