Abstract

These regulations, organized in six Parts and five Schedules, prescribe the environmental standards and measures for the treatment of effluent before discharge from various sources into water or land. A general obligation is set up, to prevent and mitigate pollution according to the legislation in force and a standard for effluent before discharge into water or land is prescribed in these Regulations (standards for general chemicals and micro-biological discharge set out in Schedule 2, standards for inorganic substances effluent discharge set out in Schedule 3 and standards for organic substances effluent discharge set out in Schedule 4). The discharge of effluent into public sewers is also regulated, by article 7. Part three is dedicated to the issuance, by the National Environment Management Authority, of licences to operate an effluent treatment plant and to obtain an effluent discharge permit, which can be issued under the imposition of conditions and requirements, as specified by article 14 and can, upon the circumstances described by article 16, be suspended or revoked. Part four is dedicated to the monitoring, records and reports: a record of volumes and quality of effluent discharged into the environment shall be maintained by the holder of a licence or permit and the authority shall conduct regular inspections and monitoring of the facility generating and discharging effluent into water or land. Events of acute pollution caused by the effluent discharge shall be immediately notified the police by a holder of a licence or permit. Part five is dedicated to offences, penalties and administrative measures. The last Part is a general one, covering revocations and containing the Schedules.
