Some basic principles for the use of land in a mountainous and hilly area are set out at article 4. A district environment committee is created with regulating, controlling and guiding functions relevant to the territory. The committee may, in turn, create a sub-committee on soil conservation, the composition, functioning and functions of which are set out by article 5. The regulations also provide for the issuance, by each district Council, of by-laws identifying mountainous and hilly areas within its jurisdiction which are at risk from environmental degradation which are maintained in a dedicated register. Restrictions on the use of mountainous and hilly areas are also established and duties are assigned to local councils, and land owners for the protection of the territory and the prevention of fires. Afforestation and reforestation policies are also foreseen for those cases in which an area is at risk from environmental degradation and so are restrictions on grazing and opening/closing activities for certain periods of time. Rules and measures are set up for the soil conservation and the introduction of alien or exotic plants or animals, contrary to the provisions of the statute and the Plant Protection Act, is considered an offence; also the wrongful disposal of hazardous wastes is considered an offence. The Regulations also contain a series of forms to be used to apply for the registration of an area or to request the permission to carry out activities, or to set up soil conservation measures and guidelines.
