Abstract This Resolution comprises 78 Articles organized into thirteen Chapters. Article 4 deals with the obligations of the holder of a mining concession or license to ensure the safety and effectiveness of work in exploration, mining or extraction areas, mines, and quarries, and in particular to take the following measures (i) prepare appropriate maps for mining operations to ensure the safe passage of equipment and workers on the site; (ii) prepare a store of explosives according to the standards determined by the Royal Oman Police; (iii) prepare a plan for dumping sites for waste resulting from mining operations and landfills for waste resulting from manufacturing, approved by the competent authorities; (iv) determine and implement the locations of periodic monitoring wells around the mine and waste sites to monitor the impact of mining operations on groundwater; (v) install a special scale to weigh the quantities of extracted ore, if necessary. Article 5 contains the measures to ensure the safety and health of the public and workers in mines, quarries, and exploration and excavation areas. Chapter Two regards the Exploration licenses. Chapter three deals with the Excavation licenses. Chapter four is dedicated to the Mining licenses, while Chapter five is on the Subsistence mining licenses. For each of these types of licenses, the Regulation indicates the procedures for requesting, duration, and related obligations. Chapter six regulates the Mining concessions, with a time of 25 years, renewable for similar periods. The renewal of the concession period shall be according to the quantity of ore to be exploited and the size of the financial investment. The chapter includes the obligations of the mining concession holder. It is also possible to explore or prospect for minerals for scientific research, as under Chapter Eight. The text in the ninth Chapter discusses various rights related to land and its surface. It outlines the need for adherence to legal measures and penalties for violations. The text also highlights the responsibilities of holders of such concessions, including obtaining approval for mining on state or privately-owned lands and ensuring the protection of public and private sites. Additionally, it addresses the rights of landowners in the context of mining concessions, including grazing and cultivation, and the conditions for granting mining licenses on privately owned land. Lastly, it discusses the obligation of mining license holders to provide fair compensation for any damage caused by mining operations to the owner of the land subject to mining rights. The twelfth Chapter outlines the control and inspection procedures related to mining operations. It grants specific powers to Ministry employees with judicial police status, enabling them to (i) enter mining concession or licensing areas during working hours for field inspections; (ii) access and collect production data, and mining operation records; (iii) issue instructions and directives to improve work and identify violations; (iv) investigate violations committed by mining concession or license holders; (v) audit production reports and verify mining reserves of extracted ore. The text also emphasizes that preventing judicial officers from carrying out their duties is considered a violation of the Mining Law.
