Abstract

This Order establishes the list of projects that must undergo an environmental impact assessment before they obtain authorization for their implementation and instructions, requirements and procedures for conducting environmental impact assessment. These include, buildings classified as residential, commercial, administrative or institutional sports facilities, social, cultural, and assembly and religious buildings, hotels, health facilities, educational buildings or other publicly accessible facilities; industries; buildings with activities which can cause hazards; warehouses for storage of hazardous materials and perishables; places where people are detained for punitive or corrective reasons or because of their mental condition, among others. It also establishes the list of activities or projects that must undergo a partial environmental impact assessment to include towers and antennas; all types of buildings except those qualified for a full environmental impact assessment; and micro hydroelectric power plants. The Order further provides that projects, works and activities which are not listed are not subject to environmental impact assessment but that in situations where it is evident that work, activity or project which is not listed has a negative and irreversible impact on the environment, the authorized organ may request the developer to conduct an environmental impact assessment. The Order places a duty on the developer of the project to select an expert environmental impact assessment practitioner who has no interests in the project to submit an official application for environmental impact assessment to the authorized organ on his behalf. After the assessment is carried out and submitted, the authorized organ makes a decision and communicates this decision to the environmental impact assessment expert.
