Entry into force notes

The Decree shall enter into force on the day of its publication in the Official Gazette.

Abstract

Aim of the provisions of the present Decree is to set forth additional measures in implementation of the provisions of a) Regulation (EC) No. 178/2002 of the European Parliament and of the Council laying down the general principles and requirements of food law, establishing the European Food Safety Authority and laying down procedures in matters of food safety, and b) Regulation (EC) No. 882/2004 of the European Parliament and of the Council on official controls performed to ensure the verification of compliance with feed and food law, animal health and animal welfare rules. The provisions of this Decree shall not apply to primary production for private domestic use or to the domestic preparation, handling or storage of food for private domestic consumption. The Decree consists of 34 articles as follows: objective (art. 1); designation of competent authorities at a national level (art. 2); designation of competent authorities at a regional level (art. 3); competencies of staff performing official controls (art. 4); 5 internal audits (art. 5); written records of controls (art. 6); reports on controls (art. 7); laboratories for the control of animal feedstuff and areas of their jurisdiction (art. 8); sampling (art. 9); arbitration (art. 10); additional controls (art. 11); contingency plan (art. 12); products originating from a EU country (art. 13); imports from third countries (art. 14); export certificate (art. 15); export of animal feedstuff which cannot be placed in the Community market (art. 16); national reference laboratories (art. 17); annual and multi-annual control plans (art. 18); precautionary principle (art. 19); public consultation - public information (art. 20); requirements regarding the safety of animal feedstuffs (art. 21); co-operation among competent authorities (art. 22); national measures for the safety of animal feedstuffs (art. 23); animal feedstuffs business operators (art. 24); obligations of animal feedstuffs business operator (art. 25); traceability (art. 26); responsibility regarding animal feedstuffs (art. 27); penal sanctions (art. 28); administrative sanctions (art. 29); administrative sanctions fee collection (art. 30); powers to the Minister of Agriculture (art. 31); amended provisions (art. 32); repeals (art. 33); annexes (art. 34).
