Abstract

Premier decrees to validate the Regulation and to supplement issue 9 of the Ministerial decree No.44 of 2000 with the following paragraph: “Federal executive body entitled with the function of the realization of state policy in the sphere of scientific, scientific and technical activity in the process of creation, running and use of artificial islands, constructions and plants for carrying out marine scientific research.” The present Regulation establishes the modalities of carrying out marine scientific research in internal sea, territorial sea, EEZ and continental shelf of the Russian Federation, including the modalities of forwarding requests for carrying out the aforementioned d research, their processing and decision-making. The present Regulation is not applicable to the applied scientific research aimed at study, exploration and fisheries of animate aquatic resources and study, exploration and extraction of inanimate marine resources. Section I lays down general provisions. Section II regards forwarding and examination of requests. Section III regards exceptional modalities of forwarding and examination of requests. Section IV regards forwarding and examination of requests of foreign applicants. Section V establishes grounds for refusal. Section VI establishes the modalities of carrying out marine research in EEZ and continental shelf of the Russian Federation by competent international organizations. Section VII establishes liability of the authorized applicant. Section VIII regards the modalities of making amendments to the program of marine research. Section IX regards data reporting and forwarding samples obtained as a result of marine research and publication of the findings. Section X regards suspension of stopping marine research. Section XI regards control over marine research. Section XII establishes the modalities of creation of artificial islands, constructions and plants for the purpose of marine research. Section XIII regards the particulars of carrying out marine research in internal sea and territorial sea or with the use of coastal infrastructure. Section XIV regards authorized representative of the Russian Federation entitled with the function of control over the observance of the conditions of permit. Section XV establishes liability for the infringement of the present Regulation.
