Abstract

This Ministerial Decree establishes the modalities of crop variety testing of agricultural crops novelty, distinguishability, homogeneity and stability by the state commission in accordance with the approved methodology. Crop variety testing shall include: (a) examination of the application; (b) testing for novelty; (c) testing of variety appellation; and (d) testing for novelty, distinguishability, homogeneity and stability. Laboratory testing shall include: (a) use of data banks to establish distinguishable features from other varieties; (b) laboratory assessment of homogeneity features; and (c) biochemical study by electrophoretic method. State commission shall issue official conclusion on patentability and shall submit it to the authorized state institution for the protection of selection achievements that shall issue patent within a month from the date of reception of the official conclusion on patentability.
