Abstract This Ministerial Decree regulates the procedure for organizing and conducting activities on fishery waterbodies and (or) fishing areas by natural persons and legal entities of commercial fisheries and artisanal (sports) fishing, and fisheries for research, control, ameliorative and reproductive purposes. Il shall be applicable to marine and inland fisheries, except for waterbodies for fishfarming and growing of aquatic animals. Use of fish resources and other aquatic animals is carried out in the order of general and special use. Fisheries shall be performed as general and special fishery management. General fishery management shall be intended use of fishes and aquatic species without removal thereof from their natural habitats. Special fishery management shall be intended use of fishes and aquatic species with removal thereof from their natural habitats, except for reintroduction purposes. Facts of bycatch of non-viable (lifeless) sturgeon species must be registered in a fishing log or permit, or in a voucher and is subject to the gratuitous delivery to state monopoly body in the field of protection, reproduction and management of wild fauna Facts of bycatch of non-viable (lifeless) of particularly valuable, rare and endangered fish species and other aquatic animals must be registered in the fishing log or fishing permit, and shall be subject to destruction by drawing up a relevant report by the state inspector attesting the destruction. Bycatch of crayfish shall be performed without removal of crustaceans of non-commercial sizes. Crayfish of a non-commercial size caught in the gear must be immediately released into the natural environment with the least damage. Coastal fisheries shall be performed on assigned fishery waterbodies and fishing areas. Marine fisheries shall be performed in the open part of waterbodies (seas, lakes) outside the limits of the assigned areas. Commercial fisheries shall not be performed in recreational fishing areas established by the local government. The right to commercial fisheries shall be granted to natural and legal persons in possession of authorization and contract with local government for fisheries and fishfarming.
