Abstract

The Regulation consists of 9 Sections dealing with the following matters: 1) general provisions (sect.1); 2) fishing species and fishing quotas (sect. 2); 3) fishing gear (sect. 3); 4) restriction of fishing periods for fishes and aquatic invertebrates (sect. 4); 5) illegal fishing and catch of aquatic invertebrates (sect. 5); 6) the rights and the duties of the lessees of fishing water bodies organizing charged artisanal fishing (sect. 6); 7) protection of fishing water bodies and fishing resources (sect. 7); 8) liability and compensation (sect. 8); 9) dispute settlement (sect. 9). The present Regulation shall be applicable to all fishing water bodies except for fish farming ponds and hatchery fish farming enterprises. Artisanal fishing shall be considered catch of fishes and aquatic invertebrates for proper consumption. Artisanal fishing shall be prohibited on the territory of protected areas and national parks. Fishing species can be any fish except for species recorded in the Red Book or temporarily prohibited for catch by the Ministry of Natural Resources and Environmental Protection. Artisanal fishing shall be carried out free of charge except for water bodies conceded in lease and some water bodies the list of which shall be validated by the Ministry of Natural Resources and Environmental Protection. In the water bodies in which stock enhancement, acclimatization of fishes, release of fishes and aquatic invertebrates are under way artisanal fishing can be restricted or prohibited by the Ministry of Natural Resources and Environmental Protection. Total allowable catch shall be set five kilograms per person daily except for cases when a single fish exceeds the established weight. The amount of crayfish caught daily must not exceed thirty pieces and the amount of shrimp must not exceed one kilogram. The utilization of more than ten fish-hooks and also double or triple fish-hooks without spoon-bait shall be prohibited. The prohibited fishing season shall be imposed annually and during spring spawning it must not be less than sixty days.
