Abstract

Governmental Commission for Control over Export, in accordance with the Ministry of External Economic Relations and State Customs Committee is entitled with the organization of control over export from the Russian Federation of pests (pathogenic agents) of human beings, animals and plants, their genetically modified forms, fragments of genetic materials and equipment that can be used for the creation of bacteriological (biological) and toxin weapons. This Regulation establishes complex of arrangements as regards control over export (transfer, exchange) from the Russian Federation of pests (pathogenic agents) of human beings, animals and plants, their genetically modified forms, fragments of genetic materials and equipment that can be used for the creation of bacteriological (biological) and toxin weapons, included in the special List export of which is subject to licensing. The requirements of this Regulation are compulsory for all types of enterprises irrespectively of the form of property subject to the jurisdiction of the Russian Federation. Russian enterprises in the process of signing contract (agreement, treaty) for export (transfer, exchange) from the Russian Federation of pests (pathogenic agents) and equipment of double purpose, included in the List, the text of the contract must report the following data: final users, purpose of utilization of the exported commodities, commitment of the importer to use the imported commodities exclusively for the declared purposes not connected directly or indirectly to the manufacturing of bacteriological (biological) and toxin weapons and must not be used as such, must not be re-exported or transferred to anyone without prior written consent to such transaction on the part of the exporter.
