Abstract

This Act amends the Mines and Minerals Development Act by inserting a new section (104A) on the duty to apply for a tax clearance certificate by a person who intends to transfer, assign or encumber a mining right conferred under sections 21, 32, 43, 51, 61 or 71 of the Act. Subject to other provisions of the Act, the transfer, assignment or encumbrance of a mining right shall be approved upon production of a valid certificate.
