Enterprises that make payments for the discharge of pollutants into the natural environment, this Methodology shall be applicable in cases of emergency or peak emission (discharge). It contains uniform rules and determines the procedure for calculating damages caused to the state by violation of water legislation by state associations, enterprises, institutions and organizations, collective farms, other cooperative and other public organizations, regardless of the forms of ownership and departmental subordination, and citizens of the Republic of Tajikistan, foreign nationals and legal entities. The expenses of enterprises, local government, related to the elimination of the consequences of pollution of beaches, rivers, lakes and reservoirs, shall be reimbursed by those responsible for such pollution. The procedure for compensation of losses caused to the state by violation of water legislation is established by a special instruction. Funds in compensation of damages caused to the state by violation of water legislation shall be transferred to nature conservation funds in the prescribed manner and shall be used for water protection measures. By the nature of the manifestations, losses shall be classified as direct (visible, in case of fish death, defective products, equipment failure) and indirect (hidden), which can occur after a considerable period of time after the establishment of the fact of violation of water legislation (reduction of biological productivity of the waterbody, service life decrease of equipment, loss of valuable animal and plant species, fish and other aquatic animals and plants).
