This Act does not apply to fishing vessels. Despite that a ship in respect of which an application for registration has been made is eligible to be registered, the Minister may direct the Registrar not to register a ship if he or she is satisfied that having regard to: (a) the condition of a ship so far as is relevant to safety or to any risk of pollution; (b) the safety, health and welfare of persons employed or engaged in any capacity on board a ship; or (c) the possibility that a ship may be used for criminal purposes; it would be detrimental to the interests of Montserrat or of international shipping for a ship to be registered. The Governor acting on the advice of Cabinet may make Regulations for, among other things, to preventing, reducing or minimizing pollution from Montserrat ships and other ships while they are in Montserrat waters. The Act also sets out the responsibilities of owner and master and compliance with the International Management Code for the Safe Operation of Ships and for Pollution Prevention adopted by the International Maritime Organisation (ISM Code).
