Keyword Marine pollution Oil pollution Liability/compensation Special fund International organization Legal proceedings/administrative proceedings Geographical area Africa, South Atlantic, Southern Africa Abstract This Act declares the Protocol to amend the International Convention on the Establishment of an International Fund for Compensation for Oil Pollution Damage to have the force of law in the Republic of South Africa and defines the territorial sea for purposes of Article 3 of the 1992 Convention, which here means Articles 1 to 36 of the International Convention on the Establishment of an International Fund for Compensation for Oil Pollution Damage as amended in 1992. The Act also empowers the South African Maritime Safety Authority to make a request for assistance to the Fund under paragraph 7 of Article 4 of the 1992 Convention. The Act also provides with respect to legal proceedings involving the Fund and regulation-making powers of the Minister. Full text English
