Abstract

These Regulations, made by the Minister responsible for Maritime Administration, in exercise of the power conferred by sections 93 and 94 of the Merchant Shipping Act 2002, provide for the control of micro-organisms, including those which have been genetically modified, cell cultures and human endoparasites, which may be able to provoke any infection, allergy or toxicity (“biological agents”) on board of Bermuda ships. curtain regulations do not apply to all activities Bermuda ships. The Regulations provide with respect to, among other things, assessment of health risks for workers on board of ships, classification of biological agents, reduction of risks, hygiene and individual protection, consultation with workers, and notification to the Minister of first-use of biological agents. The Regulations also provide for inspection and other measures in respect of ships registered outside Bermuda and enforcement of detention of ships. The employer shall, for the purpose of undertaking an assessment, give particular attention to— uncertainties about the presence of biological agents in human patients or animals and the materials and specimens taken from them; the hazard represented by biological agents known or suspected to be present in human patients or animals and materials and specimens taken from them; and the risks posed by the nature of the work.
