These Measures enter into force on 1 October 2005.
Abstract

These Measures are composed of 29 articles. The purposes of these Measures are to prevent and control environmental pollution by discarded dangerous chemicals. Discarded dangerous chemical is defined in article 3. The State shall encourage and support the adoption of economic and technical policies in order to fully recycle and utilize discarded dangerous chemicals in a safe and rational way. Producers, importers, sellers and users of dangerous chemicals shall be responsible for the prevention and control of pollution by discarded dangerous chemicals (art. 8), and they shall establish a system of management and formulate plans for the management of discarded dangerous chemicals and report them to the environmental protection department (art. 9). A permit for operation of dangerous wastes shall be issued by the environmental protection department in order to undertake the collection, storage, utilization and disposal of discarded dangerous chemicals (art. 11). In case any entity should change its line of production or stop production it shall properly dispose the equipment for the production and storage of dangerous chemicals, test the soil and underground water around the factory, compile environmental risk assessment reports, and report them to the environmental protection department. A distinguishing mark of dangerous wastes shall be put on the containers and packages of discarded dangerous chemicals. The environmental protection departments at or above the county level shall have the power to make supervision and inspection on the entities that bring about, collect, store, transport, utilize and dispose discarded dangerous chemicals. Articles 21 to 28 contain penal provisions.
