The regulations apply to certain ships operating in the marine environment and require them to carry an approved shipboard oil pollution emergency plan, have access to shore-based programmes for damage stability and structural strength, and report any oil pollution incidents or observations to the competent authorities. The regulations also apply to the operators of harbours, ports and oil handling facilities in the Falkland Islands and require them to prepare and maintain an oil pollution emergency plan, submit it to the authority for approval, and report any observed or probable oil discharge or presence to the authority. The regulations assign functions to the Governor and the authority in relation to the arrangements for preparedness and response to oil pollution incidents, the assessment and reporting of such incidents, and the coordination with other states and the IMO. Inspections of ships are carried out by persons appointed by the Governor to verify compliance with the regulations, and prescribe offences and penalties for non-compliance.
