Abstract

Fisheries administration consists of a Department of Fisheries, headed by a Director and a Fisheries Advisory Committee to be appointed by the Minister. The Director shall develop and keep under review fisheries plans in accordance with section 4. Declared objective of fisheries management and development shall be "to ensure the optimum utilisation of fisheries resources in the waters of the Bahamas for the benefit of the people of the Bahamas". An exclusive fishery zone is established the outer limit of which is a line drawn in such a manner that any point on it is two hundred miles from the baseline from which the territorial sea is measured (sect. 7). Within the exclusive fishery zone, the Act asserts the sovereign rights and exclusive authority of The Bahamas, for the purpose of exploring, exploiting, conserving and managing the fishery of the seabed and subsoil and superjacent waters. Foreign fishing is allowed within the waters of the Bahamas in accordance with provisions of sections 9 and 10. Fisheries Access Agreements may be concluded with other States in accordance with section 8. Section 12 provides for local fishing licences, whereas sections 13 to 16 concern matters affecting both kinds of licences, such as conditions, cancellation and suspension. Section 23 lists prohibited fishing methods and defines some offences including landing of fish caught with illegal methods. Other provisions concern import and export of live fish, employment of non-Bahamians on vessels, powers of authorized officers and other matters relating to enforcement ,penalties, legal proceedings and regulation making powers of the Minister (42 sections divided into 4 Parts)
