Entry into force notes
This Act enters into force on the day the Minister may appoint by notice.
Abstract

This Act makes amendments in the Principal Act in accordance with the implementation of the International Convention on the Control of Harmful Anti-fouling Systems on Ships (2001), International Convention for the Control and Management of Ships' Ballast Water and Sediments (2004), International Convention on Liability and Compensation for Damage in connection with the Carriage of Hazardous and Noxious Substances by Sea (1996), International Convention for the Prevention of Pollution from Ships (1973) as modified by the Protocol of 1978, and the Nairobi International Convention on the Removal of Wrecks (2007). This Act inserts Part-IA Administrative and Planning Provisions concerning the provisions on the responsibilities of the Ministry, the establishment of a National Marine Pollution Committee, and the development and implementation of the National Marine Spill Contingency Plan. Section 5 of the Principal Act is replaced by the requirements related to garbage on ships and new Section 5A about the controls on the discharge of sewage from ships, new Section 5B about the harmful substances in packaged form, new Section 5C about the controls over air pollution from ships, new Section 5D about the controls over ballast water, new Section 5E about the hull cleaning and scraping, and new Section 5F about the anti-fouling paints and systems are inserted in compliance with the international conventions above mentioned. Section 10 is amended by updating provisions on the waste reception facilities at ports. Finally, the amounts of administrative fines are updated in several sections.
