Abstract The Act consists of 41 sections divided into 6 Parts: General Provisions (1); Marine Fisheries (2); Fish Breeding and Mariculture (3); Protection and Improvement of Marine Fisheries Resources (4); Control (5); Penalties (6). The purpose of this Act is to protect marine water and mariculture, to regulate fishing and fish farming as well as catching of other marine organisms (not defined) in Bosnian marine waters. Article 1 defines marine fishing as catching, breeding, improvement and protection of marine fishes and other marine organisms. Article 3 allows fishing by Bosnian organizations and individuals. Article 8 defines "commercial fishing" and "sport fishing". Commercial fishing may be carried out only by persons who are registered in the fishing register (art. 9). Article 10 grants priority of fishing to who arrives first in the fishing area, and regulates the allocation of catch. Articles 11 to 13 regulate the use of gear, including driftnets. Crustacean may not be fished from 1 October to 30 April of each year (art. 15). Articles 16 to 20 regulate sport fishing. Chapter 3 provides summarily for the authorization of marine fish farming. Permits for fishing or fish farming shall be issued by competent municipal authorities. Provisions of Chapter 4 prohibit young or undersized fish (art. 25), provide for the establishment of a close season (art. 25), the regulation of fishing nets and mesh size (art. 26), and prohibit the use of explosives or poisonous substances (art. 27), and the discharge of waste (art. 28). Remaining provisions prohibit the use of various fishing methods or gears. Control shall be carried out by the Agricultural Inspection Service.
