Such program shall be applied for with the National Marine Fisheries Service (NMFS). NMFS cannot conduct a program in any fishery subject to the jurisdiction of a Council or a state unless NMFS first receives a request from the Council or the governor to whose jurisdiction the fishery is subject. Each program must be: (1) Necessary to prevent or end overfishing, rebuild stocks of fish, or achieve measurable and significant improvements in the conservation and management of the reduction fishery; (2) Accompanied by the appropriate environmental, economic and/or socioeconomic analyses, in accordance with applicable statutes, regulations, or other authorities; and (3) Consistent with the Controlling fishery management plan or program (CFMP), including any reduction amendment, for the reduction fishery. Reduction programs shall imply reduction contracts to be awarded by a bidding process.
