This Legislative Decree enters into force on the day of its publication.
Abstract

This Legislative Decree approves the text of the Nagoya Protocol on Access to Genetic Resources and Fair and Equitable Sharing of Benefits, derived from its Use in the Convention on Biological Diversity, concluded during the 10th Meeting of the Conference of the Parties to the Convention, held in October 2010 (COP-10), and signed by Brazil on February 2, 2011, in New York. The approval is conditioned to the formulation of declarations containing the following understandings: in accordance with: -I the provisions of art. 28 of the Vienna Convention on the Law of Treaties; -II the provisions of art. 8 of the Protocol, economic exploitation for the purpose of agricultural activities will be subject to the sharing of benefits provided for therein; -III the provisions of art. 2 of the Convention on Biological Diversity, species or varieties that form spontaneous populations that have acquired their own distinctive characteristics in the country are considered to be found in in-situ conditions, as defined in the art. 2 of Law No. 13.123 of 20 May 2015, etc.
