Abstract

The Act aims at financing the safeguard and sanitation of contaminated sites that are of considerable danger to people’s health or to the environment. Section I (arts. 1 and 2) contains definitions, section II (arts. 2-12) describes when a sanitation fee incurs (e.g. long-term depositing, storage and exportation of waste), who is liable, how to calculate the amount, and rules of procedure. The amount (art. 6) depends on the type of waste and the type of site for disposal. Section III and IV (arts. 13-19) regulate the sanitation process from the discovery of sites suspected of being contaminated, to the registration of the site in the register of contaminated sites, to the adoption of the sanitation measures, the definition of obligations for real estates owners to allow entry into their grounds, as well as rights of the authorities and compensation for damages. Section V (arts. 20-25) contains final and interim provisions as well as penal provisions (art. 22).
