Abstract This Law regulates the rights and duties arising for persons from the creation of new varieties of plants and from their commercial exploitation. Article 2 includes a list of definitions of terms used within the law. This includes provisions on the granting of breeders' certificates and the rights and duties of breeders and originators. A Breeder's Certificate is granted on condition that the variety is distinct, uniform, stable and new (art. 4). The owner of a Breeder's Certificate shall have the exclusive right to exploit the variety or breed commercially (art 8).
